Forest Management Agreement (FMA) - Public Engagement
Background
Section 14(1) of the Forestry Actprovides the authority to remove Crown Timber within the province through either a Cutting Permit (Domestic or Commercial), Timber Sale Agreement, or a Crown Timber Licence (CTL).
The Department of Fisheries, Forestry and Agriculture is exploring options to provide additional commercial forestry opportunities within the province through the issuance of a CTL, which has the below requirements:
The assignment of the timber rights within a defined geographical location
Long term arrangement over a 20 year period, with five year review/renewal cycles
Development of a Forest Management Agreement (FMA)
Agreement that assigns Timber Rights only, which is not permitted to be transferred, reassigned or used as security for debt
Agreement is not a treaty or land claim agreement within the meaning of section 25 or section 35 of the Constitution Act, 1982
Non Forestry Crown Rights are not to be impacted or restricted
The recipient of an FMA must have a timber processing facility with a detailed business plan, supporting rationale for a Timber Licence
Forest Management Agreement Process
The Minister of Fisheries, Forestry and Agriculture is seeking public input on the implementation of an FMA with Miawpukek First Nation.
Forest Management Area Location
The proposed FMA represents 179,952 hectares and is located along the Bay d’Espoir highway within a portion of Forest Management District (FMD) 6 as identified on the map below.

The Department of Fisheries, Forestry and Agriculture is seeking public input on the proposed FMA with Miawpukek First Nation. Feedback can be provided by completing the online questionnaire.
The collection of information is done under the authority of section 61(c) of the Access to Information and Protection of Privacy Act, 2015, for the purpose of collecting public feedback on the Crown Timber License.
Any personal information that may be received will be governed in accordance with the Access to Information and Protection of Privacy Act, 2015 and will only be used for the purpose of providing a response to submissions received and informing participants of public engagement results at the end of the process.
